Purpose: The purpose
of this amendment is to replace section 9(3) of the Bill which
currently restricts who is able to benefit from financial support
under section 8.
The amendment provides
examples of eligibility criteria that may need to be met in order
for a person to be eligible for support. The amendment sets
out, on the face of the Bill, that support may be provided subject
to requirements being met. These requirements may relate to
the characteristics of the land, for example, the ecological
features of the land. Another requirement could relate to the
person receiving support – for example, this could be someone
who is new to farming and who wants to access support or someone
who wants to diversify the agricultural activities that are
undertaken.
Effect: The amendment
will replace subsection (3). The amendment refers to eligibility
criteria (essentially pre-conditions to financial and other support
provided under section 8). It expressly introduces the concept of
eligibility that the Bill has a provision to check (for example,
whether the criteria are met) in section 11.
It provides a
mechanism by which schemes can define eligibility criteria. This
criteria will be determined by each individual scheme established
under section 8. Eligibility criteria may evolve over time as
farm businesses, farming and land management adapts and
changes.
The wording of the
provision reflects the flexibility Welsh Ministers need to set
eligibility criteria for schemes operating under section
8.
